By applying to join the IIHF Membership & Insurance Scheme, you agree to the following:
1. Membership, Legal Compliance & Standards
- You agree to comply with the IIHF Constitution, Rules, Codes of Practice, and Safety Standards, including EN 14960:2019 (and any subsequent revisions or updates).
- You agree to comply with all applicable legislation governing the use, hire, and operation of inflatables and fairground equipment, including but not limited to the Planning and Development Act 2024 and associated regulations relating to fairground equipment.
- You acknowledge that operating inflatables without valid certification or in breach of applicable legislation may constitute a criminal offence.
- You agree that all inflatables under your ownership, control, or operation must be:
- Fully and accurately declared to the IIHF and your insurer;
- Covered by valid and current public liability insurance; and
- Supported by a valid safety certificate issued by a Suitably Qualified Individual (SQI) in accordance with legal requirements.
- You acknowledge that failure to fully declare all inflatables or maintain compliance may invalidate your insurance cover, including cancellation from inception.
2. Documentation, Verification & Audit
- You agree to provide the IIHF, upon request and within a specified timeframe, with copies of all documentation required to verify compliance, including but not limited to:
- Safety test reports and certificates
- Insurance schedules and certificates
- Hire agreements and records
- Inspection and maintenance records
- Any other relevant compliance documentation
- You agree that the IIHF reserves the right to:
- Verify and assess all documentation submitted;
- Request additional information or clarification;
- Carry out compliance checks or audits where reasonably required.
- Failure to provide requested documentation, or the provision of incomplete, inaccurate, or misleading information, may result in immediate suspension or termination of membership and/or access to the insurance scheme.
3. Data Collection, Use & Sharing
- You consent to the IIHF collecting, storing, and processing your data for the purposes of:
- Membership administration
- Insurance placement, underwriting, and renewal
- Safety compliance, monitoring, and enforcement
- You consent to the IIHF sharing relevant information with:
- Insurance brokers and underwriters
- Regulatory authorities and government bodies
- Safety authorities and enforcement agencies
- Approved inspectors and testers
where necessary for compliance, risk management, or legal obligations.
- You acknowledge that such data sharing is necessary to protect public safety and maintain the integrity of the IIHF scheme.
4. Non-Compliance, Misrepresentation & Enforcement
- The IIHF reserves the right, at its sole discretion, to:
- Suspend or terminate membership;
- Withdraw access to the IIHF insurance scheme;
- Remove an operator from the IIHF public directory;
where there is evidence of:
- Breach of these Terms & Conditions;
- Non-compliance with IIHF standards or applicable legislation;
- Misrepresentation (including insurance, certification, or operational activities);
- Failure to cooperate with reasonable compliance requests.
The IIHF may report serious breaches to:
Insurers
- Regulatory authorities
- Enforcement agencies
You acknowledge that misrepresentation of insurance or safety compliance may constitute a serious offence and may result in legal consequences.
5. Liability & Indemnity
- The IIHF acts as an administrative and representative body and accepts no liability for:
- The operation, setup, or supervision of inflatables;
- Any injury, loss, or damage arising from member activities.
- You agree to fully indemnify and hold harmless the IIHF, its officers, representatives, and agents against any:
- Claims
- Losses
- Damages
- Costs (including legal costs)
arising from:
- Your business operations;
- Your negligence or misconduct;
- Your breach of these Terms & Conditions;
- Your failure to comply with legal or safety obligations.
6. Governing Law & Jurisdiction
- These Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland.
- Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
7. Acceptance & Declaration
- You have read, understood, and agree to be bound by these Terms & Conditions;
- All information provided is true, accurate, and complete;
- You understand that providing false or misleading information may result in immediate removal from the IIHF scheme and notification to insurers and relevant authorities.
